CORRUPTION AT KENNESAW STATE UNIVERSITY

It is a scenario that too many people are familiar with in 21st century America. You are going about your business, trying to make it to class or to work, when you are suddenly surprised with an encounter with police. While unfortunate, most people are engaged with fear and uncertainty when dealing with police officers; that is just the way our society works, and that is the reputation that police have gained in our country. Recently an on campus employee went to “The Commons”, a dining hall on campus, to pick up his final paychecks and unbeknownst to him the KSU Police were waiting on him when he arrived.
When the campus employee, a working class hero named Gus James, arrived to “The Commons” to collect his last paycheck, he was greeted by an unknown Sodexo manager as well as three KSU police officers. In a questionable incident, the KSU Police were acting more like private corporate security as opposed to objective men of the law. Because Gus had several “problems” in the past with his employer, he came armed with an audio recording device hidden in his clothing and captured what transpired in its entirety.
In the official police report, the leading officer in the case, Officer BJ Putnam, states that a criminal trespass warning was issued to Gus after he received his final pay checks. 
In the official police report, the officer stated that Gus said, “I have a constitutional right to come and go as I please.” While this may seem like a minute detail, the consequences are immense. Not only did Gus not say this, no one that was there, in the 13 minutes of audio, made this statement or any statement similar to this. There is no possibility that statement could have been misunderstood or said by someone else that was there because it NEVER HAPPENED. There is no logical explanation as to why this statement was included in the official police report, which is a sworn document, other than the fact that Officer Putnam potentially fabricated this alleged statement in a futile effort to portray Gus as defiant or hostile.
As the event went on Gus exercised his right to decline signing the warning. On the audio tape, the officer Putnam said in response to Gus’s decline, “Refuse to sign? I like that even better.” In this case, the event clearly shows an officer’s deliberate, if not malicious falsification of an incident report. At the conclusion of his call, as part of his duty as a sworn officer of the court, officer Putnam is mandated to complete a written report that directly reflects what he personally observed or witnessed. That document is supposed to represent the facts but contains a fabricated statement and alleged that Gus had made it. What the officer did not know is that Gus was carrying an audio recording device that captured the interaction in its entirety.
The reality is frightening, once Gus knew what was happening he had two choices; lay down and accept what happened, or take action and right the wrong that had been bestowed upon him. In the wake of the incident, many different avenues of further negligence and potential corruption were exposed. Many entities were contacted regarding the incident on campus including the KSU Police Chief: Chief Cochran, KSU’s President’s Office, KSU Legal Affairs, and the Board of Regents. After the incident was thoroughly explained, all four of these entities took virtually no action, ended or refused further contact with Gus, have ceased to cooperate on any level, and stunningly the KSU Police Chief Cochran was quoted as saying on audio recording, in reference to the incident, “I have no concern.” It is the duty of one if not all of these entities to not only acknowledge what happened but to take action. At the request of the Georgia Department of Public Safety, Gus sent a hard copy of the audio recording to both the KSU Police Department and KSU’s President’s Office by certified mail, return receipt. Delivery was confirmed by the USPS on December 9th 2011.
There are some rays of hope shining through this dark situation. Contact made to the Georgia Department of Public Safety, Cobb County Police Department, and the Equal Employment Opportunity Commission were all very successful. All three indicated, after having the situation explained to them in its entirety, that what was being conveyed to them was clearly a violation of various laws and that it must be taken very seriously by the governing bodies at Kennesaw State University. By law, Officer BJ Putnam can potentially be prosecuted by the Cobb County District Attorney’s office for perjury and / or breach of oath by a sworn officer of the court.
When a potentially dishonest cop is caught in the act, it brings into question every other incident he has been involved with in his career. One must ask if he has ever written an illegitimate citation or made an improper arrest as he may have been driven by some cryptic, maligned motive. The surface has been scratched, the cat is out of the bag, and it is now up to the governing bodies of Kennesaw State University to act, to act now and to impugn justice.
